These terms and conditions outline the rules and regulations for the use of Check Yourself Website.

When you use our website to place an order with us, these Terms and Conditions of Business will constitute a legally binding agreement between you and us. It is your responsibility to carefully read these Terms and Conditions of Business before using this website. Your use of the Check Yourself website is contingent upon your acceptance of our Privacy Policy and the following Terms and Conditions of Business. (“Check Yourself Policies”). If you do not agree to the Terms and Conditions of Business contained in the following pages, then you may not use the Check Yourself website. Please note that Check Yourself has the right to modify these Terms and Conditions of Business and, thus, you should review them periodically.

1. Definitions

“Seller” means Check Yourself a division of Fuzed, registered in New Zealand, (in these Terms and Conditions also means ”Check Yourself”) whose registered office is at 4 Western Springs Road, Kingsland 1021 Auckland New Zealand.

“Buyer” means the person whose name is printed on the Order.

“Contract” means the order and Order Confirmation (incorporating any Special Conditions)

“Faulty” means containing a fault or defect; imperfect or defective.

“Goods” means the goods or services which the Seller is to sell in accordance with these Terms and Conditions of Business.

“Order” means the Buyer’s order for Goods or services.

“Order Confirmation” means the Seller’s written Confirmation pursuant to Condition 3(b).

“Price” means the price together with postage and packing in force at the date and time of the Order, subject to any promotional offer or discount then applicable.

“Person” means any person, firm or company.

“Special Conditions” any conditions in relation to orders set out and designated as such in the Order Confirmation.

“Terms and Conditions of Business” means the standard terms and conditions of business set out in this document.

“Writing” includes, other than for the purpose of Condition 9, email clearly bearing the names of the sender and the recipient and writing on the screen of a visual display unit or other similar device.

2. Basis of Sale

  1. These Terms and Conditions of Business and any Special Conditions will govern the Contract to the exclusion of any other terms, including any terms and conditions which the Buyer may purport to apply under any purchase order, confirmation of order or other document.
  2. Any variation of these Terms and Conditions of Business and the Special Conditions will only bind the Seller if agreed in Writing between authorised representatives of the Seller and the Buyer.
  3. The Seller’s employees are not authorised to make any representations concerning the Goods unless confirmed by the Seller in Writing. In entering into any Contract and in accepting delivery, the Buyer acknowledges that it does not rely on representations concerning the Goods which are not confirmed in this way.

3. Orders and Specifications

  1. All Goods are offered for sale subject to availability and subject to the Seller’s acceptance of the Order.
  2. The Seller reserves the right to reject any Order without the obligation to assign any reason for so doing. No Order shall be deemed accepted by the Seller unless and until it is confirmed unconditionally by the Seller in the Order Confirmation.
  3. The Seller has a policy of continuous product development and reserves the right to amend the specifications of any of the Goods without prior notice. Goods supplied may therefore differ as a consequence of multi-standard colour systems, notably the international screen based colour system of RGB and the print colour system used by Check Yourself.
  4. The Seller endeavors to display and describe as accurately as possible the printed colours of the Goods which appear on its website, but cannot undertake to give any assurance that the colours of Goods supplied will exactly match those displayed on the Buyer’ s monitor.

4. Price, Payment and Currencies

  1. Prices are clearly marked as being either inclusive or exclusive of GST. GST is added based on the final value of your order in the check-out process, at the rate applicable to your country. The Buyer shall be responsible for any other taxes applicable in the territory to which the Goods are sent.
  2. Payment must be made by credit card or debit card at the time of placing an Order which is accepted by the Seller. Payment in full will be taken at this time and the Contract will be in force.
  3. The Buyer undertakes that all details provided to the Seller for the purpose of the Order and its delivery will be correct and that the chosen method of payment is the property of the Seller and that sufficient funds or credit facilities are available to cover the full cost of the Goods ordered. The Seller reserves the right to obtain validation of the Seller’s credit card or debit card details before accepting the Buyer’s Order.

5. Delivery

  1. The place for delivery of the Goods will be as shown on the Order and the normal method of delivery (unless specifically agreed otherwise) shall be regular postage.
  2. The Seller will endeavor to process the Order and manufacture the Goods within the time period stated for each item. However manufacturing time varies by item of Goods and it is the policy of the Seller to combine items of the same type into separate shipping packages. Each package of like items will be sent separately by regular post, unless otherwise stated in the Order Confirmation as soon as it is completed. Any dates quoted for delivery of the Goods are indicative only. Time for delivery will not be of the essence of the Contract and the Seller will not be liable for any loss or expenses sustained by the Buyer arising from any delay in the delivery of the Goods howsoever caused.
  3. The Buyer must inspect the Goods on delivery and, in the case where Goods have been delivered by carrier, sign the required proof of delivery document or collection acceptance document. A signature on that document will constitute conclusive evidence against the Buyer of receipt of the quantity of Goods indicated on that document free from any apparent defect or damage The Buyer may not reject the Goods or any part of them solely on the grounds of short delivery of an installment. If the Goods are alleged to be damaged or defective on delivery, a description of the alleged damage or defect must be given in writing at the time of delivery and signed by or on behalf of the Buyer.
  4. The Seller reserves the right to make delivery of the Goods by installments. If the Goods are to be delivered in installments, each delivery will constitute a separate contract. The Buyer may not treat the Contract (as a whole) as repudiated if the Seller fails to deliver any one or more of the installments or if the Buyer has a claim in respect of any one or more of the installments.
  5. If the Buyer wrongfully fails to take delivery of the Goods, the Seller shall be under no obligation to refund the Price
  6. Goods may not be returned to the Seller except as provided in Condition 7 below.

6. Risk and Property

  1. Risk of damage to or loss of the Goods will pass to the Buyer upon delivery to our chosen carrier. Property in the Goods will not pass from the Seller until the Seller has received full payment of the Price and all other sums which are due, owing or payable by the Buyer to the Seller in respect of the Contract or any other Contract between the Seller and the Buyer.
  2. Risk and Limitation of Liability for Client Data. The Client acknowledges and agrees that We shall not be held responsible or liable for:
    i) anything related to the Web Site, Hosting Services or any other Services provided;
    ii) any supplied content breaching any Acts, legislation or regulations, unless due to the negligence of Us;
    iii) any loss, corruption, or deletion of files or data (including, but not limited to software programmes) resulting from illegal
    hacking of Services provided by Us. We will endeavour to restore the Web Site, files or data (at the Client’s cost), and it is the sole responsibility of the Client to back-up any data which they believe to be important, valuable, or irreplaceable prior to Us providing the Services. The Client accepts full responsibility for the Client’s software and data and We are not required to advise or remind the Client of appropriate backup procedures (unless included as part of the Services);
    iv) any loss or damage to the Client’s software or hardware caused by any ‘updates’ provided for that software;
  3. The Client acknowledges that any advice or recommendations by Us are provided on the basis of our industry knowledge and experience only and shall not be deemed as specialist advice.
  4. We, its directors, agents or employees will not be liable in any way for any form of loss or damage of any nature whatsoever suffered, whether arising directly or indirectly, by the Client or any person related to or dealing with the Client out of, in connection with or reasonably incidental to the provision of the Services by Us to the Client.
  5. The Services (and any associated software) are provided on an “as is, as available” basis. We specifically disclaim any other warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose.

7. Returns, refunds and rights of cancellation

  1. The Buyer shall have the right to cancel any Order for Goods only in the following circumstances:
    (i) if the Seller has failed to deliver the Goods ordered within 28 days after the date of the Order
    (ii) in the case of Faulty Goods at the earliest opportunity after the Buyer has discovered the fault or defect (provided that the Buyer shall be deemed to have inspected the Goods as soon as reasonably practicable after delivery and in no case longer than 14 days after receipt)

We employ the use of cookies. By using Check Yourself's website you consent to the use of cookies in accordance with Check Yourself’s privacy policy.

Most of the modern day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting.

Unless otherwise stated, Check Yourself and/or it’s licensors own the intellectual property rights for all material on Check Yourself . All intellectual property rights are reserved.

2. Our Website CheckYourself.nz

Our website at CheckYourself.nz sells print goods and web based data collection services which are aimed at business users – from start-ups and independent designers to larger organisations. This website is not intended for children and we do not knowingly collect data relating to children.

Check Yourself is the data controller responsible for this website and any handling of personal data carried out by or on behalf of Check Yourself.

Check Yourself works collaboratively to bring great print goods data collection services to Check Yourself’s customers all over the world, and they may sometimes be acting as joint data controllers. When we mention “Check Yourself”, "we", "us" or "our" in this privacy policy, we are referring to the relevant company in the Check Yourself group of companies responsible for processing your data.

3. Personal data which we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We collect a variety of information about our wonderful customers (you!) and visitors to the Check Yourself website. This personal data falls into these categories:

Identity Data includes title, first name, last name, username or similar identifier and an encrypted version of your login/password. If you interact with us through social media, this may include your social media user name.

Contact Data collected of the buyer includes billing address, delivery address, email address and telephone numbers.

Financial Data includes payment card details.

Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.

To provide better content and service, CheckYourself.nz uses the Google Analytics service. Google records mouse actions and scrolling movement, as well as basic interactions with website forms. We do not track your browsing habits across other third-party websites and all information about you which reaches Google Analytics contains no personal data about you. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. If you use any of these types of personal data on products you design or create on CheckYourself.nz we will not be able to tell. We will treat all the personal data included in designs or products as ordinary personal data.

Remember, if you choose not to share personal data with us, or refuse certain contact permissions, we might not be able to provide the products and services you’ve asked for.

4 Why do we collect this information?

We only collect your personal information that you submit in order to:

  1. Allow registered businesses to keep a record of who has visited their premises
    i) Only owners of businesses registered with Us can see contact information of individuals that check yourself to said business.
    ii) Businesses not registered with Us will not have individuals data shared with them
    iii) Businesses must only use visitor information for health and safety record keeping. Data will not be used unless you have opted in to receive updates from the business owner
  2. If required, we would share data with the Ministry of Health New Zealand in order to help trace the spread of Covid-19.
  3. To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs

If you check in a guest, you must have their permission to enter their data. If you do not, we recommend that you add them as a dependent. This will show someone was with you but will not record any personal information about them.

5. How do we protect your information?

  1. Form submissions are secured using TLS 1.2 SSL from the submitters browser through to the database. SSL (Secure Sockets Layer) is the standard security technology for establishing an encrypted link between a web server and a browser. This link ensures that all data passed between the web server and browsers remain private and integral. SSL is an industry standard and is used by millions of websites in the protection of their online transactions with their customers.
  2. Encrypted at Rest - Forms and submissions are stored in a database that is encrypted at rest.
  3. Employee Access Restriction - The only people who have access to your data is the directors of Fuzed (trading as Check Yourself) and any technical required to maintain systems and provide advanced technical customer support.
  4. Regularly maintained systems - We regularly update the technology and systems we use to stay on top of the latest vulnerabilities.
  5. Any administration access to this information is also protected 2 Factor Authentication (2FA)

6. Do we use cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognise your browser and capture and remember certain information.

We use cookies to understand and save your preferences for future visits.

7. Do we disclose any information to outside parties?

Your personal data may be used to help protect New Zealand in the fight against Covid-19 in which time your personal data will be sheared with the New Zealand Ministry of Health. Unless you have opted out the buyer; Business owner of where the Check Yourself scan was made may from time to time send you updates from said business.

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. However when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for statistical analyses, or other uses.
